OnTour Privacy Policy

This Privacy Policy describes how WayMaker Technology, Inc. (“WayMaker,” “we,” “our,” or “us”) collects, uses, stores, processes, and protects information in connection with the OnTour platform and related services (the “Services”).

OnTour is a business-to-business software platform provided to property owners, operators, and management companies (“Customers”). We intentionally limit the collection and retention of personal data and process information primarily as a data processor / service provider, not as a consumer-facing platform.

This Privacy Policy applies to:

  • Information processed through Customer use of the Services.
  • Audio recordings and related metadata processed through the Service
  • Information collected through our website, support channels, and business operations

This Policy does not apply to consumer services or to personal data that Customers collect independently of the Service.

1. Information We Collect

We intentionally limit personal data collection. We may collect and process the following categories of information:

  • Audio recordings, including voices and spoken information captured during property tours, where enabled by Customer.
  • Transcriptions generated from recorded audio.
  • Tour-related notes, comments, and metadata.
  • Performance analytics, scoring outputs, and benchmarking data.
  • Prospect interaction data voluntarily provided during tours.
  • Account information for Authorized Users (e.g., name, email, role).
  • Technical data such as device type, browser type, IP address, and usage logs.

We do not intentionally collect:

  • Sensitive personal data (e.g., SSNs, biometric identifiers for identification)
  • Consumer behavioral tracking data
  • Precise geolocation data

2. How We Use Information

We process information to:

  • Provide, operate, and maintain the Services.
  • Generate transcriptions and AI-driven analytics.
  • Improve platform performance and accuracy.
  • Provide customer support.
  • Maintain security and prevent fraud or misuse.
  • Develop aggregated and anonymized benchmarking insights.
  • Meet legal and contractual obligations

Audio is processed only to provide the Service's functionality. We do not analyze audio for advertising, profiling, or unrelated purposes. We do not use audio recordings to train public or general-purpose AI models. We do not sell Customer Data. We do not use Customer Data for advertising purposes.

3. Legal Basis & Customer Responsibility

Customers are responsible for ensuring that appropriate notice and consent are provided before recording conversations, and for complying with all applicable federal, state, and local privacy and recording laws.

WayMaker processes Customer Data on behalf of and under the instruction of the Customer, consistent with the applicable Subscription Agreement.

4. Data Sharing & Disclosure

We may share information:

  • With the Customer that controls the Workspace.
  • With service providers who assist in operating the Services (e.g., hosting providers). All service providers are contractually bound to:
    • Process data only on our instructions
    • Maintain appropriate security safeguards
    • Comply with applicable data protection laws
  • When required by law, regulation, subpoena, or legal process.
  • To protect the rights, safety, or property of WayMaker, Customers, or others.

4.1 Business Transactions

If we undergo a merger, acquisition, or sale of assets, data may be transferred subject to confidentiality and data protection obligations.

5. Data Retention

Audio recordings and associated data are retained only for the duration specified by the Customer or as configured within the Service. WayMaker retains Customer Data only as long as necessary to provide the Services and fulfill contractual obligations, unless otherwise required by law.

Technical logs are retained for limited periods consistent with security and compliance requirements.

Upon termination of a Customer agreement, data is deleted or returned according to contract terms.

6. Data Security

We implement commercially reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, or alteration including:

  • Encryption of data in transit and at rest
  • Access controls and role-based permissions
  • Audit logging and monitoring
  • Secure development and change management practices

No method of transmission or storage is 100% secure. We cannot guarantee absolute security but we continuously assess and improve our security posture.

7. International Data Transfers

Information may be processed and stored in the United States or other jurisdictions where WayMaker or its service providers operate.

8. Individual Rights

Depending on applicable law, individuals may have rights to:

  • Access personal data
  • Correct inaccurate data
  • Request deletion or restriction
  • Object to certain processing

Because OnTour is a business-to-business platform, individuals should direct privacy-related requests to the Customer that controls the Workspace.

Where required by law, WayMaker will assist Customers in responding to verified privacy rights requests.

9. Cookies and Tracking Technologies

The Service uses minimal cookies necessary for authentication, security, and core functionality.

We do not use third-party advertising cookies or cross-site tracking technologies.

10. Children's Privacy

The Services are not intended for individuals under the age of 16. We do not knowingly collect personal information from children.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected by updating the “Last Updated” date above.
